Ian Smith, one of the rebellious owners of Atilis Gym in Bellmawr, New Jersey, says that the State seized the entirety of their legal defense fund.
In a tweet he made on January 13, Smith claimed the total amount that was "taken" from their account was $173,613.603
Smith doesn't enforce wearing a mask in the gym, which violates the New Jersey COVID-19 protocols, and he reopened his gym during the State's lockdown. The business was fined $15,000 every day that it didn't abide by the protocols.
In an interview, Smith told Tucker Carlson that the defense fund would move forward with only using cash so that the same incident doesn't happen again.
A spokesperson from the New Jersey Attorney General's office said, "The State has not seized their bank account funds. However, the State has obtained judgments against the owners and intends to collect on them. The total due and owing as a result of court-entered judgments to date is $134,463.08."
The next day after the interview, representatives from the State said that the information given by Smith wasn't correct, that all of his money wasn't seized but "frozen as a result of a bank levy having been issued due to the State's collection efforts."
